On November 22, 2022, at a Walmart in Chesapeake, Virginia, an employee opened fire, killing six fellow employees and injuring four before turning the gun on himself. Seeking Improved Threat Assessment and Workplace Violence Prevention

Briana Tyler, one of the Chesapeake Walmart mass shooting survivors, initially filed a $50 million lawsuit against Walmart in November 2022. Tyler’s case argued that Walmart knew of Andre Bing’s “violent tendencies towards co-workers but opted to hire him despite this. The suit also claimed that due to the shooting, Tyler suffered physical harm to her “legs and chest” and severe emotional trauma, including “night fright, paranoia, and new fears.”

Tyler’s initial lawsuit over the shooting encountered a hurdle, as a judge asserted that insufficient evidence existed to consider the assault a “personal attack,” given the absence of proof of any relationship between Tyler and the shooter beyond their work environment. In light of this setback, Tyler’s latest lawsuit asserts that the shooter made direct eye contact before aiming his firearm toward her.

Her position asserts that the company’s failure to take action stemmed from “willful” negligence over these threats, suggesting that this attack could have been avoided.  The situation highlights the urgent need for a comprehensive workplace violence prevention program for organizations and an increase in high-quality security solutions to safeguard workers and customers.

Seeking Accountability for Workplace Safety Failures and for Ignoring Warning Signs

Sarah Merlo, another survivor of the tragic shooting, has also filed a lawsuit against Walmart, seeking $20 million in compensatory damages and $350,000 in punitive damages.

Merlo’s lawsuit contends that Walmart was negligent in addressing employees’ complaints about the shooter’sviolent behavior and ominous comments about his enjoyment of killing animals and describing the smell of animal carcasses. The shooter was known among employees for making subtle active shooter threats and exhibiting  suspicious behaviors, such as paranoia, delusions, and verbal abuse. The consequences of disregarding these signs highlight the importance of recognizing warning signs and implementing security measures before the escalation of violent behavior can even occur.

Merlo’s account describes her attacker discovering her behind a table, on her hands and knees, at which point the attacker smiled and shot her in the face, followed by six additional shots targeting her neck, chest, elbow, and stomach.
