Tyler’s initial lawsuit over the shooting encountered a hurdle, as a judge asserted that insufficient evidence existed to consider the assault a “personal attack,” given the absence of proof of any relationship between Tyler and the shooter beyond their work environment. In light of this setback, Tyler’s latest lawsuit asserts that the shooter made direct eye contact before aiming his firearm toward her.
Her position asserts that the company’s failure to take action stemmed from “willful” negligence over these threats, suggesting that this attack could have been avoided. Merlo’s account describes her attacker discovering her behind a table, on her hands and knees, at which point the attacker smiled and shot her in the face, followed by six additional shots targeting her neck, chest, elbow, and stomach.
